Youth Law Project
Equality Advocates’ mission is to achieve equality
for lesbian, gay, bisexual, and transgender (LGBT)
individuals in Pennsylvania through direct legal services,
public education, and policy reform. Founded in 1986,
Equality Advocates is the only organization in the
Commonwealth of Pennsylvania offering direct legal services
for the LGBT community.
In September 2007, Equality Advocates launched a new
project aimed at providing direct legal services, advocacy,
education and outreach to children and youth affected by
anti-LGBT bias in Pennsylvania.
Project Attorney Katie Stewart received funding from the
law firm of Skadden, Arps, Slate, Meagher & Flom, LLP
to implement Equality Advocates’ Youth Law Project.
The Youth Law Project will combat the pervasive effects of
anti-LGBT bias on Pennsylvania’s children and youth
through direct legal services, education, and policy
reform. The project takes an innovative approach by serving
both LGBTQ youth and children raised in LGBT-headed
families. The project will advocate for youth facing
anti-LGBT harassment, discrimination, and abuse in
institutional settings and at home. The project will also
confront the effects of discrimination against LGBT parents
on their children through advocacy in second-parent
adoptions and in dependency proceedings where anti-LGBT
bias is a factor. The goals of this project are: (1) to
improve and broaden services available to both constituent
groups; (2) to advocate for policy reforms at the state,
local, and institutional levels to equalize opportunities;
and (3) to improve the safety and permanency of LGBTQ youth
and children of LGBT parents.
Services for LGBTQ youth include:

Representation of LGBTQ youth facing harassment or
discrimination in schools, including intervention with
schools and litigation against school districts for unequal
treatment, illegal blocking of GSA formation, and failure
to take appropriate action to protect youth from harassment
and abuse.
- Representation of LGBTQ youth in the Philadelphia foster
care system at dependency hearings to ensure that clients
are treated fairly and placed appropriately.
- Outreach and education for LGBTQ youth, including regular
on-site legal clinics at LGBTQ youth centers throughout
Pennsylvania.
- Advocacy for state, local, and institutional reform,
including lobbying for the introduction of anti-bullying
legislation with LGBT-inclusive language and the adoption
of safe school policies and LGBT training programs.
Services to protect children in LGBT-headed families
include:
- Representation of low-income LGBT parents in
second-parent adoptions of their partners’ children
to help non-biological co-parents formalize legal ties with
their children.
- Representation of LGBT parents with children in the
Philadelphia foster care system at dependency proceedings
when anti-LGBT bias is a factor in placement and permanency
planning.
- Advocacy for fair and uniform procedures for
second-parent adoptions, including lobbying for state-wide
uniformity, as well as for individual counties to
reconsider their currently prohibitive and biased
standards.
